Hemp Studios Limited (Pharm Biotics) a UK registered company (number 12381741) with its registered office at Kemp House, 152 – 160 City Road, London, England, EC1V 2NX on 31 December 2019 (we/us/our). We are the data controller in relation to all personal data you give to us in connection with the purchase of Pharm Biotics products or from visiting our website at www.pharmbiotics.co.uk (Website).

 

Unless otherwise required by law, the Information Commissioner’s Office (ICO) guidance or best practice, or in order to perform our contract with you, we will only process your personal data in the way we tell you or in the way you ask us to, and we will give it back to you at any time.

 

Whilst we will use all reasonable efforts to safeguard your personal data, you acknowledge that the use of the internet is not entirely secure and for this reason we cannot guarantee the security or integrity of any personal data which are transferred from you or to you via the internet.

  2. What data we take and how we use your data
    1. We take your name, email address, billing address, shipping address and telephone number when placing an order, submitting an enquiry through our website, entering one of our promotions, e-casts, or trade and consumer shows. We use this personal data primarily to perform our contract with, and sell our products to you, however, it may be used for any of the purposes outlined in 3.2.
    2. All payment details (such as bank account or payment card details) you provide to us in order to pay for your products will be processed through, and retained by, Shopify International Limited, a company registered in Ireland with its registered office on 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4D04 XN32, Ireland (Shopify) – they are an affiliate of US company, Shopify, Inc. with servers located in the USA and Canada and they host our customer database. Payment details may also be held by VivaWallet.com Ltd a company registered in England and Wales with its registered office at Part Second Floor West Wing, Ashton House, Silbury Boulevard, Milton Keynes, Buckinghamshire, United Kingdom, MK9 2AH (VivaWallet).
    3. We will use your name and email address for marketing purposes where we have your consent to do so. You can withdraw this consent and opt-out from our marketing communications at any time. Please note that order-related emails cannot be opted out of as they are generated automatically with every order and are evidence of your order confirmation.
    4. When you correspond with us by phone or e-mail as part of our business with you, any of your personal data contained in any call or in that correspondence (including your IP address and location) will be retained by us.
    5. We consider the personal data we obtain is reasonable and necessary for the purposes set out in 3.2. However, we review this intermittently and remove any inaccurate or obsolete data.
    6. We also collect, use and share aggregated data and Google Analytics or similar such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product order or account that you have with us but we will notify you if this is the case at the time.
  3. The purpose for which we will use your personal data
    1. Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data.   4. How long we keep it and where we store it
    1. Once collected, your personal data will be retained by us for as long as reasonably necessary to fulfil the purposes we collected it for, whilst you remain our customer (including any warranty provided by us to you), to market our goods to you (where requested) and to enable us to improve our Website. After this point, the data will be securely deleted and we will not contact you unless you ask us to.
    2. You will remain our customer for up to 13 months after the date of your last order/booking. After this point, we may contact you by email to see if you’d like to remain on our database and delete your data thereafter if not.
    3. Where data is stored by the third parties listed at 6.1 the terms of which this data is held is determined by their own privacy policy which is also listed.
    4. We will use technical and organisational measures to safeguard your personal data, for example:
      1. we store your personal data on secure servers;
      2. payment details are encrypted and made using SSL technology

    1. In relation to all of your personal data, you have the following rights (in addition to any rights you may have under the Act or the Regulation) to ask us:
      1. not to process your personal data for marketing purposes;
      2. to clarify what data we hold about you, how it was obtained, to whom it has been disclosed and for how long it will be stored;
      3. to amend any inaccurate data we hold about you;
      4. to delete any of your data (where you no longer think we need to hold it, or you think we have obtained or processed it without your consent at any time); and
      5. to only process your personal data in limited circumstances, for limited purposes.
    2. We have the capacity to extract your personal data from our databases and provide it to you in a structured, commonly-used way (typically by .csv file).
    3. If you wish to exercise any of your rights at any time, please contact us on the details contained at the beginning of this policy in the first instance. We will require you to verify your identity to us before we provide any personal data, and reserve the right to ask you to specify the types of personal data to which your request relates.

Where you wish to exercise any of your rights, they may be subject to payment of a nominal administration fee (to cover our costs incurred in processing your request) and any clarification we may reasonably require in relation to your request. Such fees may be charged where we consider (acting reasonably) that your request is excessive, unfounded or repetitive.

    2. We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

When you use our Website, we will automatically collect technical information about the device you use to visit, including your IP address, 18+ information, live location, browser type/version and related settings. We also monitor your use of our Website. This includes the full URLs, your clickstreams through our Website, the pages you view and how you interact with them and how you leave the Website.
